Terms of Use

1. About ASHA

ASHA ("we", "us", "our") is a fitness tracking application developed and operated by Lash Development Co, based in Australia. By creating an account and using ASHA, you agree to these Terms and Conditions and our Privacy Policy.

These terms apply to all users of ASHA, including those who access the app through a referral link or referral code.

Data collected through the app may be used by Lash Development Co to analyse usage patterns, improve existing features, and develop new functionality for ASHA over time. All data used for these purposes is handled in accordance with our Privacy Policy and the Australian Privacy Act 1988.

If you do not agree with any part of these terms, you must not use the app.

2. Eligibility

You must be at least 18 years of age to use ASHA. By creating an account, you confirm that you are 18 years of age or older.

ASHA does not permit users under the age of 18 to create an account or use the app. This restriction is in place due to the social networking features of the app (including public posts, direct messaging, friend connections, and a Discover page), and in compliance with recent changes to Australian law regarding the protection of minors online, including the Online Safety Amendment (Social Media Minimum Age) Act 2024 (Cth).

We take the safety of young people seriously. If we become aware that a user is under 18, their account will be suspended and their data deleted in accordance with our Privacy Policy.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately if you suspect any unauthorised use of your account.

Your display name, username, and profile information may be visible to other users based on your privacy settings. You are responsible for the accuracy of information you provide.

Display Name & Username Changes by Lash Development Co

You agree that Lash Development Co reserves the right to change, reset, redact, or remove your display name, username, profile photo, cover photo, bio, or any other publicly-visible profile field at any time, at our sole discretion, without prior notice to you. Reasons we may exercise this right include (but are not limited to): names or content that are offensive, harassing, hateful, vulgar, sexually explicit, impersonating another person or entity, infringing on intellectual property, brand-impersonating ASHA or Lash Development Co, or otherwise in breach of these Terms or our community guidelines. Where reasonably possible, we will assign a placeholder name and notify you via email or in-app message after the change is made. Continuing to use ASHA constitutes acceptance of this right.

Acceptance of Terms — Record-Keeping

When you sign up for ASHA, and each time these Terms are updated and you continue to use the app, we record the date and time you accepted these Terms and Conditions, the version of the Terms accepted, and the device, IP address and country from which acceptance was made. This record is retained for the lifetime of your account and for a reasonable period afterwards for legal, audit and dispute-resolution purposes. You may request a copy of your acceptance record at any time by emailing support@ashafit.com.

4. Data We Collect

We collect the following categories of personal information:

Account Information

Display name, username, email address, encrypted password (managed by Supabase Authentication), date of birth, sex/gender (optional), city, local gym (optional), profile photo, cover photo URL, and linked social media usernames (Instagram, TikTok — optional).

Fitness Data

Workout logs, exercise history, personal records, goals, weight lifted, reps, sets, rest times, running routes (GPS coordinates if location permission is granted), swimming sessions, cycling sessions, and Hyrox results.

Social Data

Profile information you choose to share, workout posts you make public, comments, likes, and friend connections.

Device & Technical Data

App usage analytics, device type, operating system version, and crash reports. We do not collect your device's unique identifiers for advertising purposes.

Location Data

Only collected when you actively start a GPS-tracked activity (e.g. a run or cycle). Location data is not collected in the background.

Financial Data (Referrer Programme only)

If you join our Referrer Programme, we collect bank account details and tax file number (TFN). These are stored encrypted and are only accessible to you and authorised ASHA personnel for the purpose of processing payouts.

We share your personal data only in the following circumstances:

Other ASHA Users

If you set a workout or post to "Public", it will be visible to all ASHA users on the Discover page. Your display name, username, and profile photo will be shown alongside your public content. You can change a post to "Private" at any time, which will remove it from the Discover feed. Your profile photo, once uploaded, is publicly visible to all users and may appear in contexts shared externally to the app (see Section 13).

Referral Data

If you sign up for ASHA using a referral code or referral link, your first name (from your display name), username, and email address will be shared with the user who referred you. This allows the referring user to verify their referral and is required for the Referrer Programme to function. By using a referral code, you consent to this sharing.

Service Providers

We may share data with trusted third-party service providers who help us operate ASHA, including Supabase Inc. (database and authentication, servers located in the United States — see Section 9), payment processors, and analytics services. These providers are bound by confidentiality agreements and may not use your data for any other purpose.

Legal Requirements

We may disclose your data if required by Australian law, court order, or a regulatory authority.

Business Transfer

In the event of a merger, acquisition, or sale of assets, your data may be transferred to the successor entity, subject to the same privacy protections.

If you opt in to marketing communications during signup or in your account settings, we may send you emails about:

Withdrawing consent does not affect service-related transactional messages (e.g. account creation confirmations, payment receipts).

8. Referrer Programme

The ASHA Referrer Programme allows eligible users to earn a 20% commission on subscription fees paid by users they refer to ASHA.

Eligibility

You must have an active ASHA account and complete the Referrer Programme signup, which includes providing social media handles (optional), Australian bank account details, and a valid Tax File Number (TFN) or Australian Business Number (ABN) for tax reporting purposes.

Earnings

Commission is calculated as 20% of each subscription payment made by a referred user while their subscription remains active. Earnings are credited to your Referrer Balance after a 30-day holding period from the payment date.

Payouts

Once the 30-day holding period has elapsed, you may submit a cashout request. Cashout requests are processed on the 3rd business day of every calendar month. Payouts are made to the bank account you provide. If a cashout request is submitted after the processing date, it will be included in the following month's batch. You are responsible for declaring referral income to the Australian Taxation Office (ATO) as required by law. ASHA may issue payment summaries as required.

Tax Obligations

If you earn referral income through ASHA, this income may be taxable under Australian tax law. ASHA does not provide tax advice. Please consult a registered tax agent if you are unsure of your obligations.

Referral Data Sharing

As stated in Section 6, when someone signs up using your referral link or code, their first name, username, and email address will be shared with you to confirm the referral.

Programme Termination

ASHA reserves the right to suspend or terminate your participation in the Referrer Programme if you engage in fraudulent activity, breach these Terms, or if the Programme is discontinued. Outstanding verified balances will be paid out on termination.

9. Data Storage & Overseas Transfer

ASHA stores data using Supabase Inc., a third-party database and authentication provider. Supabase servers are located in the United States (AWS ap-southeast-2, Sydney region where available).

Under the Australian Privacy Principles (APP 8), before transferring personal information overseas, we take reasonable steps to ensure the overseas recipient handles the information in a way that is consistent with the APPs. Supabase Inc. is bound by our Data Processing Agreement and complies with international data protection standards including SOC 2 Type II.

By using ASHA, you consent to the transfer of your personal information to Supabase's servers as described above.

We retain your personal information for as long as your account is active, or as needed to provide you with services.

Under the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs), you have the following rights:

Access & Data Portability

You have the right to obtain a copy of all personal information we hold about you. You can request a full data export at any time by using the "Download My Data" button in Settings > Account > Privacy & Data. Your data will be compiled and sent to your registered email address in a machine-readable format (JSON) within 30 days. This right is provided in accordance with APP 12 (Access to personal information).

Correction

You can update your personal information at any time through your account settings or by contacting us. Under APP 13, we are required to take reasonable steps to correct personal information we hold if it is inaccurate, out of date, incomplete, irrelevant, or misleading.

Deletion

You can permanently delete your account and all associated personal data at any time by using the "Delete Account" button in Settings > Account > Privacy & Data. Account deletion is processed within 30 days and is irreversible. See Section 10 for retention details relating to financial records required by Australian law.

Data Breach Notification

In the event of a data breach that is likely to result in serious harm to you, we will notify you and the OAIC as required under the Notifiable Data Breaches (NDB) scheme.

Complaints

If you believe we have mishandled your personal information, you can:

  1. Contact us at support@ashafit.com and we will respond within 30 days.
  2. Lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au if you are unsatisfied with our response.

12. Security

We take reasonable technical and organisational measures to protect your personal information from unauthorised access, disclosure, alteration, or destruction.

Measures include: encrypted data transmission (TLS/SSL), encrypted storage of sensitive financial data (AES-256), row-level security in our database, secure authentication managed by Supabase Auth, and regular security reviews.

No method of electronic transmission or storage is 100% secure. We cannot guarantee absolute security but are committed to protecting your data to the best of our ability.

13. User-Generated Content

When you post workout summaries, comments, or other content and set it to "Public", that content becomes visible to all ASHA users.

You retain ownership of the content you post. By making content public, you grant ASHA a non-exclusive, royalty-free licence to display that content within the app.

You must not post content that is abusive, illegal, or infringes the rights of others. ASHA reserves the right to remove content that violates these Terms.

Profile Photos

By uploading a profile photo to ASHA, you acknowledge and agree to the following:

Prohibited Profile Content

Profile photos must not contain any of the following:

ASHA reserves the right to remove any profile photo at any time, without prior notice, if it is deemed to violate these Terms or is otherwise inappropriate. In cases of serious or repeated violations, ASHA may suspend or permanently delete your account at its sole discretion. You will be notified by email if action is taken against your account due to profile content.

13A. Reporting Other Users

ASHA provides an in-app reporting feature that allows you to report users who you believe are violating these Terms and Conditions or engaging in behaviour that is harmful, abusive, or inappropriate.

When submitting a report, you may select from predefined categories (such as inappropriate profile photo, harassment, spam, or impersonation) and provide additional details in your own words. All reports are reviewed by the ASHA team.

By using the report feature, you agree to submit reports in good faith. Deliberately submitting false, misleading, or malicious reports may result in action being taken against your own account, including suspension or termination.

ASHA will review all reports and may take actions including, but not limited to: removing content, removing profile photos, issuing warnings, temporarily suspending accounts, or permanently deleting accounts. The outcome of a report review is at the sole discretion of ASHA and may not be disclosed to the reporting user for privacy reasons.

13B. Application Content Standards

ASHA is a fitness and workout tracking application designed for users aged 18 and over. The application itself does not contain, display, or promote any of the following:

All content within ASHA relates exclusively to exercise, fitness tracking, workout planning, and health-related goal-setting. Users are expected to maintain these standards in any user-generated content (including usernames, workout names, and profile photos) as outlined in the Prohibited Profile Content section above. Violations may result in content removal or account suspension at ASHA's sole discretion.

14. Subscription & Payments

ASHA operates on a subscription model. Current pricing and terms:

Free Trial

All new subscribers receive a 7-day free trial. During the trial period, you have full access to all ASHA features at no charge. Your subscription will automatically convert to a paid subscription at the end of the trial unless cancelled at least 24 hours before the trial ends. Any unused portion of a free trial is forfeited if you cancel.

Subscription Price

$2.99 AUD per week after the free trial period.

Billing Cycle

Weekly, starting from the end of your free trial period.

Auto-Renewal

Paid subscriptions to ASHA are auto-renewing. Payment is charged to your Apple ID or Google Play account at confirmation of purchase. Your subscription automatically renews at the end of each billing period (weekly, monthly, or yearly, as selected) unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the price of the selected plan. You can manage your subscription, including turning off auto-renew, at any time through your device's subscription settings (Apple: Settings → [your name] → Subscriptions; Google: Play Store → Profile → Payments & Subscriptions). No refund is provided for the unused portion of any billing period, except where required by Australian Consumer Law.

Payment Method

Payments are processed through the Google Play Store or Apple App Store using your selected payment method. ASHA does not store or have access to your full credit card details.

Price Changes

We will notify you at least 14 days before any price changes take effect. You will need to actively consent to any price increase.

Cancellation

You can cancel your subscription at any time through your device's subscription settings (Google Play Store > Subscriptions, or Apple Settings > Subscriptions). Cancellation takes effect at the end of your current billing period. You will continue to have access to premium features until your current period expires.

Refunds

Refunds are handled in accordance with the Australian Consumer Law (ACL). Under the ACL, you have automatic consumer guarantees that cannot be excluded. If you believe you are entitled to a refund due to a service failure, contact us at support@ashafit.com. For billing errors, you may also contact the Google Play Store or Apple App Store directly.

Cooling-Off Period

You have a 48-hour cooling-off period from the time of your first subscription purchase. If you cancel within this period, you will receive a full refund.

15. Loyalty Reward Credits

ASHA offers a loyalty reward programme for active subscribers. For every 3 consecutive paid subscription weeks, you earn 1 free week of credit valued at $2.99 AUD.

Key terms of the Reward Credits programme:

(a) Earning Credits

Credits are automatically awarded after every 3 consecutive paid weeks. Each free week earned counts as 1 week toward your next 3-week cycle.

(b) Nature of Credits

Reward credits are non-transferable app credits issued as a bulk refund of subscription fees. Credits are NOT income, salary, wages, or any form of payment to the user. They are a promotional discount applied to your subscription cost.

(c) Credit Balance

Your accumulated credit balance is visible in the Settings screen of the app. Credits accrue in your account and become available as an app credit refund 30 days after they are earned.

(d) Payout

After the 30-day holding period, accrued credits are processed as a bulk app store credit refund to your original payment method. ASHA reserves the right to process payouts in batches.

(e) No Cash Value

Credits have no cash value outside the ASHA app and cannot be exchanged for cash, transferred to other users, or applied to any other product or service.

(f) Tax Responsibility

Reward credits are promotional discounts, not income. However, you are responsible for understanding any tax obligations that may apply in your jurisdiction.

(g) Programme Changes

ASHA reserves the right to modify, suspend, or discontinue the Loyalty Reward Credits programme at any time with 14 days notice. Any credits already earned will be honoured.

(h) Forfeiture & Expiry

If your subscription is cancelled or expires, any unpaid credits remain in your account for 90 days. After 90 days of inactivity, unredeemed credits may be forfeited. Regardless of subscription status, all reward credits expire 2 years from the date they were earned if not redeemed. ASHA will make reasonable efforts to notify you before credits expire.

(i) Abuse

ASHA reserves the right to suspend reward credits for any account suspected of abusing the programme, including but not limited to creating multiple accounts or manipulating subscription status.

16. Data Export & Account Deletion

Data Export

You may request a complete copy of your personal data at any time. Use the "Download My Data" feature in Settings > Account > Privacy & Data. Your data will be compiled into a machine-readable format (JSON) and emailed to your registered email address. The export includes your profile information, workout history, goals, social connections, subscription history, and any other data associated with your account.

Processing Time

Data export requests are typically processed within 24 hours but may take up to 30 days in exceptional circumstances.

Account Deletion

You may permanently delete your account at any time using the "Delete Account" option in Settings > Account > Privacy & Data. Account deletion is irreversible and will result in the permanent removal of:

17. Medical Disclaimer and Assumption of Risk

ASHA is not a medical service and does not provide medical advice, diagnosis, or treatment. Workouts, programs, weights, suggested progressions ("Push" recommendations) and any other content displayed in ASHA are provided for informational purposes only. You acknowledge that exercise involves an inherent risk of injury, including serious injury or death, and that you participate in any activity logged, suggested, or performed through ASHA entirely at your own risk.

You agree to consult a qualified medical professional before commencing any new training program, particularly if you have any pre-existing medical condition, injury, are pregnant, are recovering from injury or surgery, are taking medication, or have any other health concern. You agree to stop exercising and seek medical attention immediately if you experience pain, dizziness, faintness, breathlessness, or any other symptom that suggests injury or illness. To the maximum extent permitted by law, Lash Development Co excludes all liability for any injury, illness, loss, or damage arising from your use of ASHA.

18. User Content Licence

When you submit content to ASHA — including but not limited to workout names, exercise notes, set comments, posts to the feed, comments, photos, profile information, display name, biography, or any other material ("User Content") — you grant Lash Development Co a worldwide, royalty-free, perpetual, irrevocable, transferable, sublicensable, non-exclusive licence to host, store, reproduce, modify, adapt, publish, translate, display, distribute, and use that content for the purpose of operating, improving, marketing and promoting ASHA and Lash Development Co's other products and services.
